1. Introduction & Acceptance of Terms

1.1 Agreement to Terms

Connect by TRADO ("Connect", "Platform", "we", "us", or "our"), a trading automation platform operated by Windigotrade Pvt Ltd, a company incorporated under the Companies Act, 2013, with its registered office at H. No. 207, Village Jant, Lawan, Lawan, Mahendragarh-123029, Haryana. By accessing, registering on, or using the Connect platform in any manner — including browsing, creating an account, configuring webhooks, subscribing to strategies, or hosting strategies — you ("User", "you", "your") unconditionally agree to be bound by these Terms and Conditions ("T&Cs" or "Agreement"), our Privacy Policy, and any supplementary guidelines, policies, or notices published on the platform from time to time. If you do not agree to any part of these Terms and Conditions, you must immediately cease use of the platform and refrain from registering or creating an account.

1.2 Legal Capacity

By accepting these T&Cs, you represent and warrant that:

  • You are at least 18 years of age or the age of majority in your jurisdiction, whichever is higher.

  • You have the full legal capacity and authority to enter into a binding contract under the Indian Contract Act, 1872.

  • You are not barred from using financial or technology services under any applicable law, court order, or regulatory directive.

  • Your use of the Platform is in full compliance with the laws and regulations of your country of residence.

1.3 Binding Nature

This Agreement constitutes a legally binding contract between you and Windigotrade Pvt Ltd. These T&Cs supersede all prior communications, representations, or agreements between you and TRADO relating to the subject matter herein. Continued use of the Platform following any amendment to these T&Cs constitutes your acceptance of the revised terms.

2. Description of Services

2.1 Platform Overview

Connect by TRADO is a Software-as-a-Service (SaaS) trading automation platform that enables users to automate their crypto trading strategies on the various exchanges using their own accounts and API credentials. The platform acts solely as a technology intermediary and does not hold, manage, or control user funds at any point. TRADO is not a broker, investment advisor, portfolio manager, fund manager, or any form of SEBI-registered intermediary. Connect is a pure automation and technology tool.

2.2 Core Services Offered

The Platform currently provides the following services:

  • Webhook Automation: Automate TradingView strategy alerts directly to exchanges via secure webhook URLs. Configure alerts in TradingView to trigger buy/sell orders on your account in near real-time.

  • Strategy Automation (Multi-Platform): Automate strategies built on Python scripts, MetaTrader 4 (MT4), MetaTrader 5 (MT5), Microsoft Excel sheets, or any other compatible external system via TRADO's automation infrastructure.

  • Copy Trading: Users may follow other traders on the platform and automatically mirror their trade executions on their own connected accounts, subject to the rules set out in Section 5 of these T&Cs.

  • Host Your Strategy: Strategy creators and developers may deploy their strategies on the Connect platform, making them available to other users on the Marketplace, subject to TRADO's content and compliance policies.

  • Marketplace: Users may browse, subscribe to, and activate live deployed strategies listed on the Connect Marketplace. Access to the Marketplace is currently free of charge, subject to change as per Section 8.

2.3 Supported Exchange

The Platform currently supports automation on CoinDCX ("Exchange" or "Broker"). TRADO may, at its sole discretion, add support for additional exchanges or brokers in the future. Any such additions will be communicated through platform notifications and updates to these T&Cs.

2.4 What Connect Is NOT

To avoid any ambiguity:

  • Connect does not provide investment advice, financial planning, or portfolio management services.

  • Connect does not execute trades on behalf of users using its own discretion — all trade execution is triggered solely by user-configured automation rules or strategies subscribed to by the user.

  • Connect does not custody, hold, manage, pool, or transfer user funds or digital assets.

  • Connect does not represent, guarantee, or imply any form of return, profit, or trading performance.

3. User Eligibility & Account Registration

3.1 Eligibility Criteria

To use the Connect Platform, you must:

  • Be a resident of a jurisdiction where crypto trading automation is not restricted or prohibited.

  • Have a valid, active account on the supported exchange.

  • Possess a valid email address for communication and account-related notifications.

  • Agree to and comply with the respective exchange's own Terms of Use and regulatory requirements, independently of these T&Cs.

3.2 No KYC Requirement (Currently)

Connect does not currently require Know Your Customer (KYC) verification for registration or platform access. Users are not required to submit identity documents, address proof, or financial information to TRADO. However:

  • KYC requirements applicable to the exchange remain fully in force and are governed solely by the exchange's policies. TRADO has no control over or responsibility for the exchange's KYC processes.

  • TRADO reserves the right to introduce KYC or enhanced identity verification processes in the future, in compliance with applicable Indian laws and guidelines issued by regulatory authorities.

3.3 Account Security

  • You are solely responsible for maintaining the confidentiality and security of your account credentials (login ID, password, API keys).

  • You must not share your Connect account, login credentials, or API keys with any third party.

  • In the event of any unauthorised access, suspected breach, or compromise of your account or API keys, you must immediately notify TRADO at team@trado.trade and also take immediate steps with the exchange to revoke or regenerate your API keys.

  • TRADO shall not be liable for any loss, damage, or unauthorised transactions resulting from your failure to maintain account security.

3.4 One Account Per User

Each user is permitted to maintain one active account on the Platform. Creating multiple accounts to circumvent restrictions, exploit features, or manipulate the Marketplace is strictly prohibited and may result in immediate termination of all associated accounts.

3.5 Accurate Information

You agree to provide accurate, current, and complete information during registration and to promptly update such information as necessary. TRADO reserves the right to suspend or terminate accounts found to contain false, misleading, or fraudulent information.

4. User Responsibilities & Prohibited Conduct

4.1 User Responsibilities

As a user of the Connect Platform, you are solely and exclusively responsible for:

  • All trading decisions, strategy configurations, and automation settings made through the Platform.

  • The performance, outcomes, and consequences of all trades executed through your connected exchange's account.

  • Ensuring that your trading activity complies with all applicable laws and regulations, including Indian tax laws, FEMA, and any applicable cryptocurrency regulations.

  • Conducting your own due diligence before subscribing to any strategy on the Marketplace or copying any trader.

  • Understanding the inherent risks of automated trading, including but not limited to: market volatility, slippage, API downtime, connectivity failures, and strategy underperformance.

4.2 Absolute Prohibition on Assured Returns Claims

In strict compliance with various regulatory mandates and in the interest of protecting users and the broader public, the following are absolutely prohibited on the Connect Platform:

  • Making, publishing, sharing, or implying any claim of "assured returns," "guaranteed profits," "fixed monthly returns," "100% win rate," "zero-loss strategies," or any similar representation.

  • Advertising strategies with specific daily, weekly, or monthly profit percentages as if they are guaranteed outcomes.

  • Promoting historical backtested or simulated results as indicative of future performance.

  • Marketing a strategy using language designed to mislead users into believing returns are certain or risk-free.

  • Promising users that they will "double their money," "earn passive income," or achieve any specific financial outcome through use of the Platform.

Any user found making such claims — whether on the Marketplace, in profile descriptions, through social media, in referral links, or in any other medium — will have their account suspended immediately, their strategy delisted from the Marketplace, and may be reported to relevant regulatory authorities. TRADO actively monitors the Platform for such violations and takes a zero-tolerance approach.

4.3 Additional Prohibited Activities

The following activities are strictly prohibited:

  • Using the Platform for any illegal, fraudulent, or deceptive purpose.

  • Attempting to gain unauthorised access to TRADO's systems, databases, or infrastructure.

  • Reverse engineering, decompiling, or attempting to extract source code from the Platform.

  • Introducing malware, viruses, bots, or harmful scripts into the Platform or its infrastructure.

  • Misusing the Platform for market manipulation, wash trading, spoofing, or any other market abuse.

  • Harvesting, scraping, or systematically collecting data from the Platform without TRADO's prior written consent.

  • Impersonating TRADO, its employees, or other users.

  • Using the Platform to solicit or recruit users for external investment pools, managed accounts, or pyramid/MLM schemes.

  • Violating the intellectual property rights of TRADO or any third party.

  • Engaging in any activity that disrupts, damages, or impairs the functionality or security of the Platform.

4.4 Compliance with Applicable Laws

Users must ensure that their use of the Platform complies with:

  • The Information Technology Act, 2000 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.

  • The Indian Contract Act, 1872.

  • The Prevention of Money Laundering Act, 2002 (PMLA).

  • All applicable crypto asset regulations, including notifications issued by the Ministry of Finance and RBI circulars.

  • Exchange's own Terms of Use and API usage policies.

5. Marketplace & Copy Trading Rules

5.1 Marketplace

The Connect Marketplace allows strategy creators ("Strategy Providers") to list and deploy their automated trading strategies for other users ("Subscribers") to subscribe to and execute on their own accounts. Access to the Marketplace is currently free of charge.

5.2 Obligations of Strategy Providers

Any user who hosts or lists a strategy on the Marketplace must:

  • Ensure their strategy listing is accurate, honest, and does not make any misleading claims about past or expected performance (see Section 4.2).

  • Not represent themselves as SEBI-registered investment advisors, portfolio managers, or research analysts unless they hold valid, current registrations under the relevant SEBI regulations.

  • Clearly disclose any significant risks associated with the strategy.

  • Not offer strategy access in exchange for referral commissions, broker account openings, or any form of compensation arrangement that may violate regulatory and exchange's policies.

  • Ensure their strategy does not execute illegal trades, engage in market manipulation, or violate any applicable laws.

5.3 Obligations of Subscribers

Users who subscribe to a Marketplace strategy or copy another trader must:

  • Independently evaluate the strategy before subscribing. TRADO does not vet, verify, or endorse any strategy listed on the Marketplace.

  • Understand that past performance of any strategy is not indicative of future results.

  • Set appropriate position sizes and risk parameters based on their own financial situation and risk tolerance.

  • Accept full and sole responsibility for all trades executed on their account through subscribed strategies.

5.4 Anti-Scam & Fraud Prevention

TRADO maintains a zero-tolerance policy toward fraudulent activity on the Marketplace:

  • No strategy may promise or imply guaranteed returns of any kind.

  • Strategy Providers may not operate as unregistered investment advisors or solicit funds for pooled trading.

  • Any user found promoting scams, Ponzi schemes, or fraudulent investment products through the Platform will have their account terminated immediately and may be reported to relevant authorities.

  • Subscribers who believe they have been misled by a Strategy Provider are encouraged to report the matter immediately to team@trado.trade.

  • TRADO reserves the right to delist any strategy, suspend any Strategy Provider, and remove any Marketplace listing at its sole discretion, without prior notice or liability.

5.5 TRADO's Role in Marketplace

TRADO acts solely as a technology facilitator for the Marketplace. TRADO:

  • Does not verify the credentials, experience, SEBI registration status, or performance claims of Strategy Providers.

  • Does not endorse, recommend, or guarantee the performance of any listed strategy.

  • Is not a party to any arrangement between a Strategy Provider and a Subscriber.

  • Is not responsible for any financial loss incurred by a Subscriber through a copied or subscribed strategy.

6. Automation & Webhook Usage

6.1 Webhook Configuration

Connect enables users to create webhook URLs that, when triggered by external platforms (such as TradingView), send trade execution signals to the user's connected exchange's account. Users are solely responsible for:

  • The accuracy and correctness of their webhook configuration, including order type, quantity, instrument, and direction parameters.

  • Ensuring that TradingView alert configurations correctly reflect the user's intended trading logic.

  • Testing webhook configurations in a controlled manner before deploying them in live trading environments.

6.2 API Key Security

  • Users must generate dedicated, appropriately-scoped accounts API keys for use with Connect. TRADO recommends enabling only "Trade" permissions and disabling "Withdraw" permissions on API keys shared with the Platform.

  • TRADO does not store or log API secret keys beyond what is technically necessary for executing automation, and employs industry-standard encryption for key storage.

  • Users must promptly revoke and regenerate API keys if they suspect any unauthorised access or compromise.

6.3 Strategy Automation (Python/MT4/MT5/Excel)

  • Users deploying strategies via Python scripts, MT4/MT5 systems, or Excel-based automation are fully responsible for the logic, accuracy, and risk management embedded in their systems.

  • TRADO does not review, audit, or validate the logic of user-created automation scripts or external strategy systems.

  • Any unintended trades, over-execution, or financial losses resulting from bugs, errors, or misconfigurations in user automation scripts are entirely the user's responsibility.

6.4 Execution Limitations

  • While TRADO strives for near-real-time execution (targeting sub-100ms latency, not guaranteed), trade execution speed and success are dependent on multiple third-party factors including exchange's API responsiveness, network latency, and market conditions.

  • TRADO does not guarantee that every signal will result in a successfully executed trade.

  • In cases of partial fills, failed orders, or slippage, TRADO shall not bear any liability for resulting financial outcomes.

7. Intellectual Property & Hosted Strategies

7.1 TRADO's Intellectual Property

All software, code, algorithms, user interfaces, databases, trademarks, logos, branding materials, and documentation on the Connect Platform are the exclusive intellectual property of Windigotrade Pvt Ltd and are protected under the Copyright Act, 1957, the Trade Marks Act, 1999, and other applicable Indian intellectual property laws. Users are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform solely for personal, non-commercial automation purposes in accordance with these T&Cs. No other rights are granted.

7.2 User-Created Strategies - Ownership

The intellectual property of any trading strategy logic, configuration, parameters, and code created by a user remains exclusively with that user ("Strategy Creator"). TRADO does not claim ownership over user-created strategies. However, by hosting or listing a strategy on the Connect Marketplace, the Strategy Creator grants TRADO a limited, non-exclusive, royalty-free licence to:

  • Display the strategy's name, description, and performance data on the Platform.

  • Facilitate the execution of the strategy on Subscribers' accounts as per their configuration.

  • Use aggregated, anonymised performance data for platform improvement and analytics purposes.

This licence does not transfer ownership of the strategy to TRADO and does not permit TRADO to sell, sub-licence, or commercially exploit the strategy independently.

7.3 Confidentiality of Strategy Logic

TRADO and its representatives shall treat the underlying logic, parameters, and code of hosted strategies as trade secrets and shall not disclose them to any third party without the Strategy Creator's explicit written consent, except where required by law or court order.

7.4 Strategy Code Custody

Strategy code deployed on the Connect Platform remains in the custody and ownership of TRADO's infrastructure solely for the purpose of execution. TRADO does not transfer, share, or licence strategy code to any exchange, broker, partner, or third party, including exchanges.

8. Fees & Pricing

8.1 Current Free Access

As of the date of these T&Cs, access to the Connect Platform — including all features such as webhook automation, the Marketplace, copy trading, and strategy hosting — is provided free of charge.

8.2 Future Fee Changes

TRADO reserves the right to introduce subscription fees, per-strategy charges, premium tiers, or any other pricing model at any time in the future. Any changes to the fee structure will be:

  • Communicated to existing users via email and/or platform notifications at least 30 days in advance of taking effect.

  • Updated in these T&Cs and on the Platform's pricing page.

  • Optional — users who do not agree to any new fee structure may terminate their account in accordance with Section 11.

8.3 No Refund Policy

Once fee-based services are introduced, all payments made for Platform access or services will be non-refundable unless otherwise stated in the specific fee policy applicable at the time of payment. This is consistent with TRADO's standard refund policy.

8.4 Third-Party Costs

Users are responsible for any fees charged by the exchange (trading fees, withdrawal fees, etc.) and by any external platforms such as TradingView (subscription fees for alerts, etc.). Such costs are entirely outside TRADO's scope and responsibility.

9. Disclaimers & Absence of Warranties

9.1 No Financial Advice

The Connect Platform is a technology automation tool only. Nothing on the Platform — including strategy listings, trade signals, Marketplace content, webinar content, educational materials, or any communication from TRADO — constitutes:

  • Investment advice, financial advice, or trading recommendations.

  • Research or analysis as defined under SEBI (Research Analysts) Regulations, 2014.

  • Portfolio management services as defined under SEBI (Portfolio Managers) Regulations, 2020.

  • Any regulated financial service requiring registration with SEBI, RBI, or any other authority.

TRADO is not registered with SEBI in any capacity. Users must consult a SEBI-registered investment advisor before making any investment decisions.

9.2 No Guarantee of Performance or Profits

  • TRADO makes no representation, warranty, or guarantee of any kind regarding the profitability, performance, accuracy, or suitability of any strategy, signal, or feature on the Platform.

  • Past performance of any strategy, whether live or backtested, is not indicative of, and does not guarantee, future results.

  • Automated trading carries significant risk of financial loss. Users may lose all or more than their invested capital. Cryptocurrency markets are highly volatile, unregulated in many respects, and subject to extreme price fluctuations.

  • TRADO expressly disclaims any and all implied warranties of merchantability, fitness for a particular purpose, accuracy, completeness, and non-infringement.

9.3 Platform Provided "As Is"

The Platform is provided on an "as is" and "as available" basis without any warranty of:

  • Continuous, uninterrupted, or error-free operation.

  • Freedom from bugs, viruses, or security vulnerabilities.

  • Compatibility with all devices, browsers, or operating systems.

  • Accuracy or completeness of any data, analytics, or performance statistics displayed.

9.4 Third-Party Dependency Risk

Connect's functionality is substantially dependent on exchange APIs and other third-party services (TradingView, cloud infrastructure providers, etc.). TRADO is not liable for:

  • Exchange API downtime, outages, rate limiting, or changes in API specifications.

  • TradingView platform issues, alert failures, or subscription lapses.

  • Any delays, failures, or errors in trade execution caused by third-party infrastructure.

  • Changes to exchange's policies, supported instruments, or trading rules that affect Platform functionality.

9.5 Cryptocurrency-Specific Risks

Users acknowledge and accept the following risks specific to cryptocurrency trading:

  • Extreme price volatility and potential for rapid, total loss of capital.

  • Regulatory uncertainty and potential for new laws or restrictions on crypto trading in India or globally.

  • Cybersecurity risks including exchange hacks, wallet compromises, and API exploits.

  • Liquidity risks, thin order books, and significant bid-ask spreads on certain instruments.

  • Smart contract risks and protocol-level vulnerabilities in underlying blockchain networks.

10. Limitation of Liability

10.1 Aggregate Liability Cap

To the maximum extent permitted under applicable Indian law, TRADO's total aggregate liability to any user — whether in contract, tort (including negligence), breach of statutory duty, or otherwise — arising out of or in connection with the use of the Platform shall not exceed the amount actually paid by the user to TRADO in the preceding 3 months. Given that the Platform is currently free of charge, TRADO's liability is effectively nil in the current free-access period.

10.2 Exclusion of Consequential Damages

Under no circumstances shall TRADO, its directors, employees, affiliates, agents, subcontractors, or technology partners be liable for:

  • Any direct or indirect financial losses from trading activities.

  • Loss of profits, revenues, capital, or business opportunity.

  • Loss of data or strategy configurations.

  • Consequential, incidental, special, punitive, or exemplary damages.

  • Emotional distress, reputational harm, or any non-economic loss.

This exclusion applies regardless of whether TRADO was advised of the possibility of such damages.

10.3 User Indemnification

You agree to indemnify, defend, and hold harmless Windigotrade Pvt Ltd and its directors, officers, employees, agents, affiliates, and successors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from:

  • Your use or misuse of the Platform.

  • Your violation of these T&Cs or any applicable law or regulation.

  • Your trading activity, including any automated trades executed through your account.

  • Any content, strategy, or listing you post or host on the Platform.

  • Any claim by a third party arising from your actions on the Platform.

  • Any harm caused by your misrepresentation of performance, returns, or strategy outcomes to other users.

11. Termination & Suspension of Access

11.1 Termination by TRADO

TRADO reserves the right to immediately suspend or permanently terminate your access to the Platform, without prior notice or liability, if:

  • You violate any provision of these T&Cs, particularly Section 4.2 (Assured Returns) or Section 4.3 (Prohibited Activities).

  • You make fraudulent, misleading, or deceptive claims about trading performance on the Platform or through any associated channel.

  • You promote guaranteed returns, Ponzi schemes, or any form of financial scam using your Connect account or Marketplace listing.

  • Your account is used for money laundering, market manipulation, or any other illegal activity.

  • You impersonate TRADO or its representatives.

  • Continuing your access poses a legal, regulatory, or reputational risk to TRADO.

  • TRADO is required to do so by law, court order, or regulatory directive.

11.2 Consequences of Termination

Upon termination of your account:

  • All rights and licences granted to you under these T&Cs will immediately cease.

  • Your webhook configurations, strategy deployments, and copy trading subscriptions will be deactivated.

  • TRADO may retain your account data as required by applicable laws (including data retention requirements under the IT Act and PMLA) or for legitimate business purposes.

  • TRADO may report violations to SEBI, the Financial Intelligence Unit (FIU-IND), the Cybercrime Cell, or other relevant authorities where applicable.

  • You remain liable for all obligations accrued prior to termination, including any indemnification obligations under Section 10.3.

11.3 Termination by User

You may terminate your account at any time by contacting TRADO at team@trado.trade or using the account deletion feature on the Platform. Termination of your account does not entitle you to any refund of fees paid (if any).

11.4 Platform Discontinuation

TRADO reserves the right to discontinue, modify, or shut down the Connect Platform or any of its features at any time, with reasonable notice where practicable. TRADO shall not be liable for any loss or inconvenience resulting from such discontinuation.

12. Governing Law & Jurisdiction

12.1 Governing Law

These Terms and Conditions shall be governed by, construed, and enforced in accordance with the laws of the Republic of India, including but not limited to:

  • The Indian Contract Act, 1872

  • The Information Technology Act, 2000

  • The Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021

  • The Consumer Protection Act, 2019

  • The Copyright Act, 1957

  • Applicable SEBI regulations and circulars

12.2 Jurisdiction

Subject to the Dispute Resolution provisions in Section 13, the courts of competent jurisdiction at Ahmedabad, Gujarat, India shall have exclusive jurisdiction to adjudicate any disputes arising out of or in connection with these T&Cs.

13. Dispute Resolution

13.1 Good Faith Resolution

In the event of any dispute, claim, or controversy arising out of or relating to these T&Cs or the use of the Platform, the parties shall first attempt to resolve the matter amicably through good faith negotiations. A party seeking resolution must provide written notice of the dispute to the other party, and both parties shall have 30 days from the date of such notice to attempt resolution.

13.2 Arbitration

If the dispute is not resolved through good faith negotiation within 30 days, it shall be referred to and finally resolved by binding arbitration conducted in accordance with the provisions of the Arbitration and Conciliation Act, 1996 (as amended). The arbitration shall be:

  • Conducted by a sole arbitrator mutually agreed upon by both parties, or, failing agreement, appointed in accordance with the Act.

  • Held in Ahmedabad, Gujarat, India.

  • Conducted in the English language.

  • Decided based on documents and written submissions, unless the arbitrator determines that a hearing is necessary.

The arbitral award shall be final and binding on both parties.

13.3 Consumer Rights

Nothing in this Section limits or excludes any rights available to individual users as consumers under the Consumer Protection Act, 2019 or any other applicable consumer protection law in India.

14. Privacy Policy

TRADO is committed to protecting the privacy and personal data of its users. The collection, storage, use, and processing of personal information by TRADO is governed by our Privacy Policy, which forms an integral part of these T&Cs. Key highlights of our privacy practices:

  • We collect only the personal information necessary to operate the Platform (email, account credentials, usage data).

  • We do not sell or commercially trade your personal data to third parties.

  • We use industry-standard encryption and security measures to protect your data.

  • We comply with the requirements of the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 and the Digital Personal Data Protection Act, 2023 (to the extent applicable and notified).

15. Changes to These Terms and Conditions

15.1 Right to Amend

TRADO reserves the right to modify, update, or revise these Terms and Conditions at any time. Changes may be made to reflect:

  • Updates to Platform features or services.

  • Changes in applicable laws or regulations.

  • New business requirements or risk management needs.

  • Feedback from users or regulatory guidance.

15.2 Notice of Changes

Material changes to these T&Cs will be communicated to registered users via:

  • Email notification to the registered email address.

  • A prominent notice on the Platform.

  • An update to the "Last Updated" date at the bottom of this document.

15.3 Acceptance of Revised Terms

Continued use of the Platform after the effective date of any revised T&Cs constitutes your acceptance of the updated terms. If you do not agree with the revised terms, you must cease using the Platform and may request account deletion.

Supplementary Clauses

Force Majeure

TRADO shall not be liable for any delay, failure, or disruption in the provision of its services caused by circumstances beyond its reasonable control, including but not limited to: natural disasters, acts of God, government actions, regulatory restrictions or bans on cryptocurrency trading, cyberattacks or exchange hacks, pandemic or epidemic events, nationwide internet outages, power failures, war, civil unrest, market crashes, exchange technical failures, or any other event constituting force majeure under Indian law.

Severability

If any provision of these Terms and Conditions is found by a court of competent jurisdiction or an arbitral tribunal to be invalid, unlawful, void, or unenforceable under applicable law, that provision shall be deemed severed from these T&Cs. The remainder of the T&Cs shall continue in full force and effect and shall be construed as if the invalid provision had never been included.

No Waiver

TRADO's failure to enforce any provision of these T&Cs or to exercise any right hereunder shall not constitute a waiver of that provision or right and shall not prevent TRADO from enforcing such provision or exercising such right in the future.

Entire Agreement

These Terms and Conditions, together with the Privacy Policy, Disclaimer, and any other policies published on the Platform, constitute the entire agreement between the user and Windigotrade Pvt Ltd with respect to the subject matter herein, and supersede all prior discussions, representations, or agreements, whether oral or written.

Assignment

You may not assign, transfer, or delegate any of your rights or obligations under these T&Cs without the prior written consent of TRADO. TRADO may assign its rights and obligations under these T&Cs to any affiliate, successor entity, or acquirer of its business without restriction.

Regulatory Advisory Notice

SEBI has, in its circular of September 2022 and through enforcement orders issued in March 2026, made clear that any platform, strategy creator, or associated intermediary that makes assured, indicative, or implied return claims is in violation of Indian securities law. Connect by TRADO strictly prohibits all such claims on its Platform. Users who encounter any listing, profile, or communication that appears to promise guaranteed returns are strongly encouraged to report it immediately to team@trado.trade. TRADO will investigate and act promptly.

Crypto assets are not currently regulated as securities under Indian law. However, users are advised to stay informed of evolving Indian regulatory frameworks governing virtual digital assets (VDAs), including applicable tax obligations under the Income Tax Act, 1961 (Section 115BBH and TDS under Section 194S).
